Acceptable Use Policy

1. Scope
This Acceptable Use Policy (“AUP”) governs your use of the BusyBuddy CRM platform and related services (the “Services”). It supplements, and is incorporated into, the BusyBuddy Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. We may update this AUP from time to time; continued use of the Services constitutes acceptance of the updated AUP.
2. Your Responsibility
You are responsible for all activity that occurs under your account and the accounts of your users, and for ensuring your users comply with this AUP. You must comply with all applicable laws, third-party platform rules (including Google, Meta, Square, PayPal, and email/SMS provider policies), and the consents and notices required from your customers and contacts.
3. Prohibited Content
You may not upload, store, transmit, or distribute through the Services any content that:
- Is unlawful, fraudulent, deceptive, or misleading;
- Infringes intellectual property, trade secret, publicity, or privacy rights;
- Is defamatory, harassing, threatening, hateful, or incites violence;
- Sexually exploits or endangers minors, or constitutes non-consensual intimate imagery;
- Promotes terrorism, organized criminal activity, or illegal drug sales;
- Contains malware, ransomware, spyware, or other malicious code;
- Discloses another person's sensitive personal information without lawful basis and consent.
4. Prohibited Conduct
You may not use the Services to:
- Violate any applicable law, regulation, or third-party rights;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure (other than as expressly permitted by our Vulnerability Disclosure Program);
- Interfere with or disrupt the Services, servers, or networks, including denial-of-service attacks, flooding, or sending malformed requests;
- Access the Services through automated means in a manner that exceeds reasonable use, evades rate limits, or scrapes data not intended for you;
- Reverse engineer, decompile, or attempt to derive the source code of the Services;
- Resell, sublicense, or operate the Services as a service bureau for third parties without our written consent;
- Use the Services for competitive benchmarking, to build a competing product, or to train machine learning models using BusyBuddy-derived data without our written consent;
- Share account credentials or transfer your account to another person without our written consent.
5. Communications: Email, SMS, and Calls
When you use the Services to send communications to your contacts, you must comply with all applicable laws and platform requirements, including the U.S. CAN-SPAM Act, TCPA, state consumer-protection laws, CASL (Canada), and GDPR/ePrivacy (EU/UK). At a minimum you must:
- Obtain and document any required prior consent (express written consent where required for SMS or autodialed calls);
- Accurately identify the sender and the commercial nature of the message;
- Honor opt-out/unsubscribe requests promptly and maintain suppression lists;
- Respect quiet hours, sending caps, and any other carrier or platform rules;
- Not send unsolicited bulk email, unsolicited marketing SMS, “cold” SMS, robocalls, spoofed sender IDs, phishing, or messages promoting prohibited goods/services.
6. Lead Sources and Third-Party Data
You may only import or ingest contacts and leads that you have a lawful basis to process and contact. Lead-source integrations (including Google Ads Lead Forms, Meta Lead Ads, Angi, and webhooks) must be used in accordance with each platform's policies. You may not purchase, rent, or scrape contact lists and import them into BusyBuddy for outreach.
7. Restricted Industries and High-Risk Uses
The Services are general-purpose business tools and are not designed or authorized for use in:
- Life-safety, emergency response, life-support, nuclear, aviation, or other systems where failure could lead to death, personal injury, or severe physical or environmental damage;
- Activities that are illegal under U.S. federal law or in your jurisdiction (including unlicensed firearms sales, illegal cannabis/CBD sales, unlicensed gambling, adult services, payday lending, and similar regulated activities) without all required licenses and our prior written approval;
- Decisions producing legal or similarly significant effects on individuals (e.g., credit, employment, housing, insurance) without appropriate human review and compliance controls.
8. Sensitive Personal Data
You may not use the Services to collect, store, or process the following without our prior written approval and the necessary legal safeguards: government-issued identification numbers (SSN, passport, driver's license), payment card numbers outside of integrated processors, financial account credentials, protected health information subject to HIPAA, biometric identifiers, precise geolocation, or data of children under 13 (or the equivalent age of digital consent in your jurisdiction).
9. Integrations and API Use
When using integrations (Google Workspace, Meta, Square, PayPal, Stripe, etc.), you must comply with the applicable third-party terms and use the narrowest scopes necessary. You may not use BusyBuddy as a conduit to violate a third-party platform's terms, to exfiltrate data from a connected account beyond what the integration is designed to surface, or to circumvent rate limits or billing.
10. Security and Account Conduct
- Keep your credentials confidential and enable multi-factor authentication where offered;
- Do not share a single user account among multiple individuals;
- Notify us promptly at security@busybuddycrm.com of any suspected unauthorized access or breach;
- Security research is welcome under our Vulnerability Disclosure Program; testing outside that program is prohibited.
11. Reporting Abuse
To report a suspected violation of this AUP — including spam originating from BusyBuddy, abusive messages, or illegal content — email abuse@busybuddycrm.com with the affected message, sender details, timestamps, and any supporting evidence.
12. Enforcement
We may investigate suspected violations of this AUP and take any action we deem appropriate, including:
- Issuing a warning and requiring corrective action;
- Throttling, disabling, or removing offending content, integrations, or features;
- Suspending or terminating affected user accounts or the entire organization;
- Cooperating with law enforcement, regulators, or affected third-party platforms;
- Preserving relevant records as required by law.
We may act without prior notice when, in our reasonable judgment, immediate action is necessary to protect the Services, our customers, third parties, or to comply with law. Violations may also result in liability under the Terms of Service.
13. Changes to this Policy
We may update this AUP from time to time. Material changes will be reflected by updating the “Effective Date” above and, where required, by additional notice. Your continued use of the Services after an update constitutes acceptance of the revised AUP.
